"PPH France-Japon : Accélérer sa délivrance de brevet"

Le premier accord PPH (Patent Prosecution Highway) entre l’INPI et l’Office des brevets du Japon (Japan Patent Office) est entré en vigueur le 01 janvier 2021. Celui-ci accélère le traitement de la délivrance des demandes de brevet étendues sous priorité d’une première demande nationale.

Les entreprises françaises peuvent désormais demander l’accélération de la procédure de délivrance du second dépôt de brevet auprès du JPO sous certaines conditions ; il s’applique réciproquement aux entreprises japonaises.

Pour aider les entreprises et les professionnels de la PI à appréhender ce nouveau PPH, nous organisons en collaboration avec la CNCPI et l’ASPI un webinaire sur le sujet : « PPH France-Japon : Accélérer sa délivrance de brevet » le jeudi 11 février de 10h à 11h.

In 2018, LESI’s Dispute Resolution Committee (DRC) had provided a comprehensive comparative study in view of recent trends in global patent enforcement, such as the decline in the number of infringement actions in the US, the rising importance of Europe, with Germany as the leading jurisdiction in terms of numbers of cases, as well as the growing interest in these actions in Asian jurisdictions, particularly China. The study was conducted for more than 1.5 years by internationally renowned patent litigators covering ten jurisdictions -- namely the US, DE, FR, NL, UK, ES, IT, CN, JP and KR.

This online seminar will discuss current trends (competitor vs. NPE litigation; patent pool activities; “hot” technical areas) related to this study, as well as revisit several key aspects as it relates to litigation in the United States and Europe -- e.g., forum shopping, availability of injunctive relief and preliminary injunctions, level of damages, timing, statistics, as well as offensive and defensive strategies in multi-national matters.

Force Majeure in international IP and Technology Licenses, outsourcing and R&D agreements

Out of our first online topic event, we learned that a lot of our members had questions related to Force Majeure. Therefore, I am now pleased to invite all members (and interested non-members) to our second virtual topic event, to be held online on Tuesday 30 June, from 12.00 to 13:00 CEST. This lunchtime event is planned in a series of regular online topic events hosted by LES Benelux, and therefore we would like to take the opportunity for an open discussion with our members.

Mr. Richard Klieman, Solicitor at Vasco Lawyers and former legal Director Europe at Applied Materials and Mr. Keith Chanroo, VP IP & Licensing at IMEC have kindly accepted our invitation to start a conversation among all LES Benelux members regarding Force Majeure with a practical international case. Mr. Hannes Abraham, Senior Associate at Pierstone Brussels, Belgium, Mr. Jurriaan Janssen, Partner at Norton Rose Fulbright, Amsterdam, The Netherlands  and Mr. Vincent Wellens, Partner at NautaDutilh Luxembourg will add some specificities per jurisdiction, also taking into consideration that consortium agreements under EC Funding projects are often subject to Belgian law.

We will touch upon some practicalities about when Force Majeure is triggered, discuss what it covers and what the differences are per jurisdiction.

Like the previous time, we would then like to open the floor to all participants, to share experiences, during this conversation and also to gauge the interest for upcoming subjects they consider relevant.

The LES100 Training Course is the introductory course in the Licensing Executives Society's Intellectual Asset Management Series and it is designed for those who are relatively new to licensing.

It is specifically aimed at:

·        Those who are considering a career in licensing and technology transfer,

·     Lawyers and Patent and Trade Mark Attorneys looking for greater familiarity with the business of IP licensing,

·        SMEs who require an introduction to licensing,

·        Entrepreneurs who need to understand the value of their IP,

·        Professors of entrepreneurship and

• Students interested in learning the basics of Intellectual Property (IP) and how to commercialise IP through licensing.

The Course covers an overview of IP and IP Licensing, divided into five Modules, with examples, exercises and interaction between instructors and fellow students in each Module:

·        Module 1: Introduction & IP Basics: This Module introduces, defines and gives examples of the different types of IP including patents, trademarks, copyright, designs and trade secrets in the context of commercialisation.

·       Module 2: Basics of IP Commercialisation & Licensing: Introduction to Licensing, including reasons for licensing, description of licensing agreements, infringement, competition law, and relationship-building.

·      Module 3: Determining Reasonable Licence Fees & Royalty Rates: This Module talks about risks and rewards, different valuation methods (Market, Financial, Cost) and their pros and cons, together with royalty structures.

·   Module 4: Managing Risks: Identify the different kinds of risk and how to manage them, i.e. confidentiality, infringement, liability, collection of royalties and other fees.

·        Module 5: Licensing Game: Students put into practice what they have learned by dividing into licensee and licensor teams that then discuss and negotiate terms on a licensing case study. At the end of the sessions all teams report their results and reasoning.

Intellectual property (IP) law poses significant challenges for general courts. This lecture will assess the trend toward establishing specialised IP courts, using examples from the United States, England & Wales and the People’s Republic of China. Set in this context, the lecture will examine the challenges facing the Unified Patent Court (UPC) in the years ahead.

Organized by LES Italy in collaboration with the WIPO Arbitration and Mediation Center and the University of Milan, the conference is an important meeting event with international speakers from the world of industry (Whirpool, Brembo, Comau, World and European Federation of the Sporting Goods Industry), research (Fraunhofer Gesellschaft, University of Milan) and with professionals from LES USA-Canada, LES Spain and LES Germany who will address the issue of licencing and intellectual property within the scope of technology transfer in different commercial sectors (mechanical, sports goods, Internet of things, etc.).

The conference will be held in English and will be an opportunity to deal with the mediation procedure of WIPO (the United Nations organization for intellectual property), (Alternative Dispute Resolution - ADR) as an alternative method for conflict resolution with regard to technology. The conference will end with a mock mediation case in the field of licensing.

Il a obtenu pour un de ses clients le montant historique le plus élevé de dommages et intérêts pour contrefaçon de brevet en Chine (157,5 M CNY, soit 21 M euros). Daochen LIU s’exprimera en anglais.

1)  La valeur du brevet et la localisation du litige en Europe et aux États-Unis. Yann Dietrich

En se prononçant sur l'existence ou non d'une contrefaçon, ou sur la validité des titres, les juges jouent un rôle décisif dans la construction de la valeur des brevets. En outre, la valeur des droits portant sur une même invention est très contrastée d'un pays à l'autre. Dans un système très favorable au détenteur du droit et sanctionnant lourdement la contrefaçon, la valeur s'envole, favorisant les dépôts de titres. Mais l'augmentation du risque juridique qui en résulte, peut être un frein à l'innovation. À l'opposé, dans un système où les sanctions sont faibles, la valeur chute et avec elle l'incitation à innover.

2) Déterminants de la valeur des brevets suite à l'analyse de 650 décisions en CTF de brevets en France. Catherine Carpentier & Luis Miotti

Si les décisions des juges ont un poids important dans la construction de la valeur, l'élaboration de standards dans l'évaluation de la qualité des brevets permet de rendre compte de leur potentiel économique, et de leur capacité à pouvoir être valorisés. L'analyse des indemnités demandées dans les litiges en CTF apporte ici un éclairage intéressant sur la contribution de ces différents facteurs à la valeur des brevets.

Many sources of information on biopharmaceutical royalty rates and deal terms rely on either Freedom of Information (FOI) sources from public companies in the United States, which only represent "material" deals that are generally more than five years old, or rely on press releases or public announcements which are often positioned for maximum publicity or promotional impact (i.e., the hyperbole of "BIO Bucks"). 

The Life Sciences Sectors of LES (U.S.A. and Canada) & LESI have partnered to conduct a landmark GLOBAL survey of royalty rates and deal terms for recent deals conducted in the past two years. The results represent significant information on early stage deals from universities, private biotech companies and deals submitted by international companies outside the USA and Canada. 

This landmark global survey is unique for the biopharmaceutical industry. The results presented in this session will be highlights of the Survey Report to be published in February 2017.  The findings provide insights certain to raise questions or challenge conventional thinking, especially for contemporary deals in recent and turbulent years.

LES Britain and Ireland are delighted to host, in association with LES Turkey, this year’s Pan-European conference on the 12th and 13th of October 2016.

Members will all understand the challenges which have beset our colleagues in Turkey and which had forced the cancellation of the conference from its original venue of Istanbul.

LES Turkey had planned an extremely interesting programme of plenaries and workshops around the central theme ‘Where Continents Meet: Being Brave for Economic Growth”.  It would have been such a shame not to have been able to receive the insights from this major market economy.
